Attorney Ferdinand Topacio warns any third parties that would like to avail of Nadine Lustre’s services of possible corresponding legal consequences.
Topacio affirmed that if a person signed a contract, it only shows that there is no oppression at hand.
Topacio stated: “As a lawyer or as a person who enters into a contract to other people, for me contract is sacred. Pag sinabi mo, you give your word, you signed that, ‘yun ay sagrado. ‘Yung sinasabi mong oppressive etc. ay hindi ka naman siguro papasok sa kontrata na oppressive, sana ‘di ka na lang pumirma.”
If by chance, there are companies who will take the risk in hiring Nadine and Viva’s top exec Vic Del Rosario goes to court to contest this, Topacio claimed Del Rosario will win the case against the third party and the Kapamilya actress.
“They have to face legal consequences of their action, and I don’t know kung ano gagawin ni Boss Vic, but if he goes to court to stop all of these, considering na meron nga existing contract, he will be well within his rights.”
In case Nadine will use medical reasons for leaving Viva films, Atty. Topacio suggested that the only escape that Nadine could do is when the third party formally asked Viva to release the actress for a certain price.
“Hindi pwedeng isa lang nasusunod na ayoko na, hindi pwede ‘yon. If there’s someone interested in Ms. Lustre’s services at kinausap nila ang Viva, and Viva agrees for a certain price to release her from her contract, pwede naman ‘yon.”
He also stressed out that Viva was the only firm that took the risk in trusting her, during the time she was just doing commercials and nothing else, considering there are a number of other talents who would be willing to be in her spot.

He continued: “Kasi ito ‘yung tao na who took a chance on you when you just doing commercials and nothing else. Marami naman talents but they took a chance. Sana naman there should be some sense of gratitude at least, hindi na ‘to legal kung di it’s morale and it’s hope.”
In addition to that, the third party and an individual trying to convince Nadine to continue breaching her contract with Viva will both face different legal consequences.
“She could be liable for breach of contract, under Article 1314 of the Civil Court, ito ay na-desisyunan ng Korte Suprema. Kung sino po ‘yung nag-uudyut sa isang tao na sirain ang kanyang kontrata may pananagutan rin po ‘yon. As to the third party, iba naman ‘yung pananagutan nila.”
Atty. Topacio firmly believes that using medical reasons is invalid.
“Kung burn out ka, dapat wala kang gagawin with anyone. ‘Di pwedeng burn out ka sa Viva, di ka burn out sa iba, hindi medical reason ‘yun. That’s a very lame excuse naman, especially may mga projects naman siya, just recently ‘yung Indak.”
Furthermore, Atty. Topacio admitted that he’s curious about why does Viva continues to provide projects for Nadine in spite of her movies not really doing well at the box office.
He said: “I was wondering in spite of the fact that Ms. Lustre’s movies are not doing very well at the box office, nagsasapalaran pa rin sa kanya ang Viva eh. Although di talaga personally involved dito, it is a certain sense of disappointment at artists doing that.”
