Ensure company’s compliance with the Retirement Law (R.A. 7641)
The law entitles minimum retirement pay to employees who retire between the ages of 60 and 65 with at least 5 years of service. The law also states that in the absence of a retirement plan, minimum retirement pay should be given to qualified retiring employees. Under this law, eligible retiring employees are paid to approximately 22.5 days per year of service.
Early retirement age (at least 55 years old and 10 years of continuous active service)
Normal retirement age (60 years old and 5 years of continuous active service)
Late retirement age (65 years old)
Proposed Resignation/Separation Benefit (optional/non-mandatory)
5-10 years of service (50% of accrued retirement benefit)
11-15 years of service (75% of accrued retirement benefit)
16 years of service and above (100% of accrued retirement benefit)
