TAPE Inc. objects to TVJ’s trademark application for ‘Dabarkads’

In a recent development, Television and Production Exponents Inc. (TAPE Inc.) has raised objections against the trademark application submitted by the trio of Tito Sotto III, Vic Sotto, and Joey De Leon, collectively known as TVJ.

This application pertains to the term “Dabarkads,” which TVJ uses to affectionately refer to their audience and supporters.

The Manila Bulletin reported that prior to TVJ’s departure from ‘Eat Bulaga’ and TAPE Inc. on May 31, they submitted a trademark application for the term “Dabarkads” to the Intellectual Property Office of the Philippines (IPOPHL).

In accordance with the law, IPOPHL published this application to provide an opportunity for any concerned parties to voice their objections.

Section 134 of Republic Act 8293, also recognized as the Intellectual Property Code of the Philippines, specifies, “Any person who believes that he would be damaged by the registration of a mark may, upon payment of the required fee and within thirty (30) days after the publication… file with the Office an opposition to the application.”

TAPE Inc. has asserted its opposition to this trademark application, contending that the term “Dabarkads” has been in active use within the context of ‘Eat Bulaga’ for an extensive period.

It’s essential to note that TAPE Inc. has also successfully renewed the trademark for the title ‘Eat Bulaga’ for an additional 10 years, with an expiration date set for June 14, 2023.
