The Makati prosecutor’s office dismissed the complaint filed against the Kapamilya actor Tony Labrusca. It got dismissed due to the technicality that it was filed past the two-month prescription period.
To recall, Labrusca faced a criminal complaint about aggravated physical injuries on June 4. It was said that the actor choked the brother of LVNA Jewelry founder, Drake Dustin Ibay.
On the same day, the Labrusca was also charged with aggravated acts of lasciviousness as he allegedly exposed a woman’s breast to a crowd and forced her to sit on his lap.
Labrusca’s attack toward Ibay’s brother allegedly took place at a house party on January 16. The complaint was only filed on June 4, which was nearly five months after the incident.
The resolution signed by Makati Senior Assistant City Prosecutor Edmund Seña said that the complaint against Labrusca is dismissed by ‘reason of prescription.
“Considering that the complaint for slight physical injuries against respondent was only filed on June 4, 2021, or after more than two months from the date of its alleged commission, the crime is already extinguished by reason of prescription.
“Wherefore, premises considered, it is respectfully recommended that the complaint for slight physical injuries against Anthony Angel Jones Labrusca, Jr., a.k.a. ‘Tony Labrusca’ be dismissed on the ground of prescription.”
Following the dismissal of the complaint, Drake Ibay released a statement saying that the fight is still not over.
According to PEP’s Cabinet Files, Ibay noted that Labrusca is not off the hook yet as his side is preparing to file for a motion for reconsideration.
“Dismissal due to technicality doesn’t mean that Tony is off the hook and dismissal due to technicality doesn’t mean the actor didn’t do what he did.
“We are filing for motion for reconsideration due to the fact that the prescription of 2 months was revised to 5 years in 2017 as per “arresto mayor” which is indicated in the resolution,” said Ibay.
He shared that his team is confident about their motion as they have strong evidence against Labrusca’s violent acts.
Ibay said that he is also speaking for his friend who was the victim of the actor’s alleged harassment.
“We are confident that our motion will be granted.
“The fight is far from over but we are confident that the evidences we have against his acts will prevail truth and justice to the victim, my friend who is a strong person.
“She is coping well and we believe justice will prevail in the end. That’s where she is getting her strength, in our confidence, from the justice system in the Philippines.”
