Quezon City Regional Trial Court has granted Viva Artists Agency’s petition against singer-actress Nadine Lustre.
According to Viva, the court orders Lustre to honor and uphold its standing contract with the agency. The court also barred Nadine from accepting any projects or endorsements without Viva’s consent and participation.
“Petitioner [Viva] has established its unequivocal right arising from the subject Revised Agency and Management Agreement.
“It has established that respondent [Nadine] contracted with them to act as sole and exclusive manager for respondent’s exercise of the profession in the show business.
“The contracts entered into by Nadine with Viva were executed with the assistance and presence of her parents at the time she was a minor. Nadine’s contracts with Viva mutually benefitted from their contractual relationship.
“The contract between the parties is the law between them, and Nadine cannot take the law into her own hands and unilaterally terminate her contract with VIVA.”
Viva filed the case in December 2020 following Lustre’s unilateral abrogation of her contract with the Viva Artists Agency.
“Lustre contracted independently with advertisers, promoters, and other third parties, disregarding her exclusive contract with Viva. The lawsuit filed seeks to stop Nadine from continuously violating her ‘agency and management contract’ with VAA.”
Meanwhile, Lorna Kapunan, the actress’s attorney, said the ruling is not at all a loss for her client.
In a series of tweets, ABS-CBN entertainment reporter MJ Felipe shared Kapunanan’s statement, saying the ruling also brought victory for Lustre after the court denied Viva’s attachment and garnishment claims on Lustre’s earnings while she’s doing projects outside of Viva.
