Earlier this year, Alex criticized the government for its slow response to the COVID-19 pandemic and the lack of initiative for a vaccine despite their promise to the public.
Earlier, President Rodrigo Duterte announced that members of the military received unauthorized COVID-19 vaccine. Then, Interior Secretary Eduardo Año’s clarified the President’s statement. He explained that Cabinet members and members of the Presidential Security Group received the said unauthorized vaccine.
On the other hand, the Department of Health and the Food and Drug Administration warned the public about the dangers of receiving any unauthorized vaccine.
Then, Presidential Spokesperson Harry Roque answered questions from the media regarding the issue. Roque classified the unauthorized vaccine as ‘tokens,’ citing Section 14 of Republic Act No. 3019, or the Anti-Graft and Corrupt Practices Act, despite its prohibitions in Section 3 and definitions of exception.
Section 3 states: “Directly or indirectly requesting or receiving any gift, present, share, percentage, or benefit, for himself or for any other person, in connection with any contract or transaction between the Government and any other part, wherein the public officer in his official capacity has to intervene under the law.”
While Section 14 states: “Unsolicited gifts or presents of small or insignificant value offered or given as a mere ordinary token of gratitude or friendship according to local customs or usage, shall be excepted from the provisions of this Act.”
