The 19-year-old performer who claimed she was sexually assaulted by Tawag ng Tanghalan champion Noven Belleza, does not want to settle her case out of court after Belleza posted a bail last week.
Belleza’s case was downgraded by the Cebu City Prosecutor’s Office saying that the proper case to be filed in court should be sexual assault, based on the evidence presented by the victim.
A complaint of rape can only be filed if there was forced used and committed by someone with power. The victim claimed that Belleza inserted his finger into her private part.
With this the case filed should be sexual assault, according to Belleza’s lawyer Leilani Villarino.
But the supposed victim’s parents who accompanied their daughter when she filed the case vowed to push through even when bail was already settled by Belleza.
Belleza’s lawyer said that a preliminary investigation is underway to give chance to refute the allegations against the singer at the prosecutor’s office.
